France officially recognises transgender woman as mother of daughter

The Toulouse Court of Appeal has recognised a transwoman, thus born as a biological man, as the mother of a daughter, Valeurs reports.

At the daughter's conception, the transwoman had legally changed sex already. However, physically she was still male. Therefore, she is technically the girl's father, Valeurs writes. However, the transwoman demanded recognition as a "non-gestational mother." She argued that her official sex change had already occurred at the time of birth.

Last Wednesday, the French court ruled that double maternal filiation should be possible. In addition, the judge considered it unnecessary to mention on the daughter's birth certificate that one of her mothers is non-gestational.

It is the first time a child is legally considered to be born of two women.
